Today, privacy is an important issue. You may have noticed that you are receiving privacy notices from various financial institutions concerning how they deal with your financial institutions concerning how they deal with your financial information. These notices are required by the Gramm-Leach-Bailey Act of 1999, which was intended to end the flood of nuisance dinnertime telemarketing calls, among other things.
The Act appears to apply indirectly to attorneys, as well. Therefore, I thought I would remind you that this firm has had policies and practices in place during its entire existence to protect your privacy.
For centuries lawyers, as a profession, have understood the importance of confidentiality in the attorney-client relationship. The nature of our relationship requires that you entrust us with a great deal of personal, nonpublic information. You provide much of that information yourself on confidential forms and in private interviews. We often collect more through our various dealings with you, others, and through our own investigatory efforts. This information shared with your lawyer is protected by a long tradition of confidentiality, Canons of Ethics and Rules of Professional Conduct.
With respect to legal representation, this firm does not reveal any information about you without your permission. The staff is instructed about the attorney-client privilege, and information obtained by the staff is given the same privileged and confidential treatment as though it was given directly to the attorney. Unless we have your permission, this firm does not give out your name, address, account information, or other personal or privileged information, except for the least disclosure needed to collect unpaid fees and expenses, disclosures required by law or by court order, or disclosures permitted by law in certain unusual situations.
This firm hopes the fact that lawyers, for centuries, have recognized the significance of your confidentiality and privacy will be reassuring to you.
